3. TERMS OF USE

3.1. Parties and Scope

These Terms of Use ('Terms') form a legally binding agreement between Percon Bilişim Çözümleri ve Danışmanlık A.Ş., established at Büyükdere Cad. Meydan Sok. No:1 Beybi Giz Plaza Kat:15 Maslak, Sarıyer/İstanbul, Türkiye ('Ferientiger', 'we', 'us') and you, the individual using the Ferientiger mobile application and/or https://ferientiger.de/app (collectively, the 'Service').

3.2. Age Requirement

The Service is intended for users aged 13 or older. Users accessing the Service from the European Union, the United Kingdom, or other jurisdictions with a higher digital-consent age must be at least 16.

3.3. Account Creation and Username

1. Registration is possible ONLY via 'Continue with Google' or 'Continue with Apple'.
2. Only your email address is obtained from your Google/Apple account.
3. Your username is generated automatically.
4. You may change your username ONCE.
5. Date of birth, address, phone number and location are not required.
6. Uploading a profile picture is OPTIONAL and visible only to you.

3.4. Account Deletion and Re-Registration

You may delete your account at any time. Deletion is PERMANENT and IRREVERSIBLE (subject to a 30-day recovery window). If you re-register with the same email address you will be treated as a NEW user.

3.5. Advertising, Affiliate Links and Social Media

• Google AdMob advertising: The Service is free and monetized through third-party ads. Ad personalization requires your UMP consent. Ferientiger is not responsible for advertised products or services.
• Advertising redirection liability: Damages arising from your use of third-party websites or applications reached via advertising redirection are SOLELY the User's responsibility.
• Affiliate links: Marked with '\*', 'affiliate link' or '#ad'. Purchases via such links may generate a commission for Ferientiger at NO additional cost to you.
• Distance sales — affiliate: Ferientiger is NOT a party to distance sales contracts concluded on redirected third-party platforms. Product delivery, right of withdrawal, payment security, defective goods/services claims and related legal rights are EXCLUSIVELY the responsibility of the relevant third-party seller and/or platform. The User agrees not to direct such claims to Ferientiger.
• Social media links: Clicking Instagram, Facebook, X or TikTok links redirects you to those platforms. Ferientiger does not transmit personal data to these platforms unless you click.
• Amazon Associates statement: 'As an Amazon Associate, Ferientiger earns from qualifying purchases.'

3.6. Prohibited Conduct

• Using bots, scrapers or other automated means to access the Service
• Impersonating another person or misrepresenting your identity
• Circumventing security controls
• Uploading content that infringes intellectual property or other rights
• Uploading unlawful, threatening, harassing, discriminatory, obscene or hateful content
• Collecting or misusing other users' data
• Using the platform for advertising or commercial promotion without our written consent
• Using any third-party software, plugin or hardware to block, manipulate or disable in-app advertising; upon detection Ferientiger reserves the right to restrict access or suspend the account

3.7. Intellectual Property

The Service, including software, design, database and content, is owned by Percon Bilişim Çözümleri ve Danışmanlık A.Ş. or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use.

By uploading a profile picture you grant us a non-exclusive, worldwide, royalty-free, revocable license, limited to displaying the picture on your own device within the Service. This license terminates when you remove the picture (subject to backup and legal retention obligations). Economic rights in the picture remain with you.

3.8. Notice-and-Takedown

Unlawful, rights-infringing or Terms-breaching content may be reported with a reasoned notice to info@percon.com. We review such notices and, if justified, remove or restrict access to the content; the content owner is informed and may object. For the German market, notice mechanisms comply with Art. 16 of the Digital Services Act (Regulation (EU) 2022/2065).

3.9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND, EXCEPT TO THE EXTENT REQUIRED BY LAW. To the maximum extent permitted by law, Ferientiger's aggregate liability shall not exceed EUR 100. Nothing in these Terms limits liability for gross negligence, willful misconduct, personal injury or any liability that cannot be limited by law. Consumers benefit from mandatory statutory rights that these Terms do not restrict.

3.10. FTC / Affiliate Disclosure

In accordance with U.S. Federal Trade Commission Guides (16 CFR Part 255), Ferientiger discloses that some links on the Service are affiliate links. As an Amazon Associate, Ferientiger earns from qualifying purchases.

3.11. Termination and Data Portability

You may terminate your membership at any time in-app or by email to info@percon.com. Upon termination, personal data are erased, destroyed or anonymized at the end of the retention periods stated in the Privacy Policy. Before closing your account you may export your content (e.g., profile picture).

3.12. Force Majeure

Neither party shall be liable for failure to perform obligations due to unforeseeable events beyond their control, including fire, earthquake, flood, pandemic, war, civil unrest, strikes, cyber-attacks and infrastructure outages. Obligations are suspended for the duration of the event.

3.13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Türkiye, without prejudice to consumer-protection rights that cannot be derogated from under the mandatory laws of your country of habitual residence (Art. 6 Rome I Regulation for EU consumers). EU consumers may bring proceedings before the courts of their Member State of domicile (Art. 18 Brussels I bis). US users agree first to attempt informal dispute resolution for 60 days; unresolved disputes will be settled by JAMS arbitration under its Consumer Arbitration Rules. Nothing waives your right to a small-claims action or a governmental complaint. ODR platform: https://ec.europa.eu/consumers/odr/

3.14. Changes

We may modify these Terms with 30 days' prior notice by in-app notification and email.

3.15. Severability

If any provision is found invalid, the remainder shall remain in effect.

5. AFFILIATE DISCLOSURE

5.1. General

Ferientiger participates in affiliate marketing programs, including but not limited to the Amazon Services LLC Associates Program and Amazon EU S.à r.l. Associates Programme. Some links on our website and in our mobile application are affiliate links. When you click on an affiliate link and complete a purchase, Ferientiger may earn a commission at no additional cost to you.

• It does NOT affect the price you pay.
• We only include affiliate links to products or services we believe will add value to our users; recommendations are based on editorial judgment.
• This disclosure complies with the U.S. FTC 16 CFR Part 255, the UK CAP Code section 5, German UWG § 5a(6), and analogous consumer-protection rules.

5.2. Disclaimer — Distance Sales

Ferientiger is NOT a party to distance sales contracts concluded on redirected third-party platforms. Product delivery, right of withdrawal, payment security, defective goods/services claims and all related legal rights are EXCLUSIVELY the responsibility of the relevant third-party seller and/or platform.

5.3. Amazon Associates Required Statement

The following statement appears on every page containing an Amazon affiliate link:

"As an Amazon Associate, Ferientiger earns from qualifying purchases."
